Our Privacy Policy ("Policy") explains how 250 Mils and its affiliates collect, use, disclose, and protect information that applies to our visual communication platform (the "Website"), and your choices about the collection and use of your information. This Policy is incorporated into and made part of our User Agreement. Please read our User Agreement and this Policy carefully. It is your choice whether or not to provide personal information to us. If you choose to do so, you are giving us your express consent to use, process, and disclose your personal information as set forth in this Policy. If you choose not to provide your personal information to us, you may not be able to use the full extent of our Websites.

Personal Information

In this Policy, "personal information" means information relating to an identified or identifiable natural person. An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identified such as a name, an identification number, location data, and online identified or to one or more factors specific to his/her physical, physiological, genetic, mental, economic, cultural, or social identity. 1. Information we collect

(a) Information you provide us directly

We may ask for certain information when you register for a 250 Mils account or correspond with us (such as a username, your first and last names, birthdate, phone number, physical and e-mail address, IP Address, Device IDs, and other information related to the use of the Website and services).

We also collect any messages you send us through the Website (such as user feedback, search queries and prompts), and may collect information you provide in User Content you post to the Website (such as text and photos you upload to use in your designs). We use this information to operate, maintain, improve and provide the features and functionality of the Website to you, to correspond with you, and to address any issues you raise about the Website.

(b) Information we receive from third-party applications

We may receive information about you from third parties. For example, if you access the Website through a third-party connection or log-in, such as Facebook Connect, by "following," "liking," adding the 250 Mils application, linking your account to the 250 Mils Website, etc., that third party may pass certain information about your use of its Website to 250 Mils. This information could include, but is not limited to, the user ID associated with your account (for example, your Facebook UID), an access token necessary to access that Website, any information that you have permitted the third party to share with us, and any information you have made public in connection with that Website. You should always review, and if necessary, adjust your privacy settings on third-party websites and Websites before linking or connecting them to the Website. You may also unlink your third party account from the Website by adjusting your settings on the third party Website. If you unlink your third party account, we will no longer receive information collected about you in connection with that Website. And if you choose to integrate with a third party application to incorporate elements into your designs, enhance media, supercharge your workflow or share to social media, we could receive data from such apps (as well as disclose data to such apps). If you communicate with us via social media, including Instagram, Facebook or TikTok and choose to share your user generated content with us, we may receive information such as videos you've created, your photo, your account name and your comments about 250 Mils.

(c) Information we receive from other third parties

We may obtain information about you from third-party sources, such as public sources, social media platforms (like Facebook, Instagram, LinkedIn, Twitter and other platforms) and third-party data providers and information Websites. Examples of the information we may obtain from such third parties include your company, company size, job title and seniority, industry and other profile information. We may share your email address or other information in order to obtain and combine this information with information that you provide to us or other information that we collect when you use our Website. We do this to better understand your profile and interests so that we can deliver customized offers and other personalized Websites to you, such as to serve relevant offers to you via email, chatbots, phone or personalized advertising. You can opt out of 250 Mils collecting more data about you from third-party providers to tailor your experience and messages we send you here(opens in a new tab or window).

Some of these providers may combine data collected from our Website through cookies, pixels, tags and similar technologies, with email or mailing addresses to which they have access to help us serve relevant offers to you.

If you are not a 250 Mils subscriber, we may obtain your contact details from a social media platform, such as LinkedIn, or a third party data provider, so that we can promote our product offerings and subscriptions to you if we think they would be helpful in your role.

We also may have obtained your details from another 250 Mils user, for example when they have shared a design with you.

We may also receive information about you and your engagement with our advertisements from our ad servers, ad networks and social media platforms. This may include the websites you visited before coming to 250 Mils so that we can determine advertising effectiveness and pay our referral partners.

(d) Information we collect from you automatically

We will directly collect or generate certain information about your use of the Website (such as user activity data, analytics event data, and clickstream data) for data analytics and machine learning, and to help us measure traffic and usage trends for the Service. We may also use third party analytics tools that automatically collect information sent by your browser or mobile device, including the pages you visit and other information , that assists us in improving the Service. (e) Cookies information and information taken from similar technologies

When you visit the Website, certain personal information may be passively collected, meaning it is gathered without your actively providing it. (f) Log file information

(g) Clear gifs/web beacons information

When you use the Service, we may employ clear GIFs (also known as web beacons) which are used to anonymously track the online usage patterns of our users. In addition, we may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. This information allows for more accurate reporting and improvement of the Service.

(h) Device identifiers

When you access the Website on a device (including smart-phones or tablets), we may access, collect and/or monitor one or more "device identifiers," such as a universally unique identifier ("UUID"). Device identifiers are small data files that uniquely identify your mobile device. A device identifier may convey information to us about how you use the Website. A device identifier may remain persistently on your device, to help you log in and navigate the Website better. Some features of the Website may not function properly if use of device identifiers is impaired. Device Identifiers used by 250 Mils include the Android Advertising ID and iOS Advertising Identifier.

(i) Location data

250 Mils collects information in order to understand where its users are located for a number of reasons. It helps 250 Mils to localize and personalize content, comply with local laws, undertake aggregated analytics, understand if its users use 250 Mils for domestic, business or educational use, improve advertising efficiency and estimate the tax liability of 250 Mils.

250 Mils may collect your precise or approximate location:

  • - from you, when you provide, correct or confirm your location (e.g., when you purchase products from us);
  • - by inferring your location from your IP address; and
  • - from our partners or your payment provider.
(j) Content within your account

We receive content that you create within your 250 Mils account and media you upload for use within it, such as designs, images, documents, videos, and metadata about your content.

2. How we use your information

We use the personally identifiable information to:

  • provide the features and functionality of the Site;
  • fulfill your requests for our products and Websites;
  • pay royalty;
  • communicate with you about the status of your orders and other inquiries about our products and Websites;
  • send you information about our products and Websites;
  • for our internal business purposes, such as data analysis, audits and so forth;
  • perform marketing activities, which may include audience development and targeting;
  • help us create content that is most relevant to you;
  • and provide notices about the results of contests, and other promotions;
  • for service administration where we need to contact you for reasons related to

  • enforce our Terms of Use Agreement
  • manage our business and perform functions as otherwise described to you at the time of collection

We use your email address to communicate with you about your account and to send you certain notification emails. You can change the frequency of those emails in your 250 Mils account settings.

If you are in the United Kingdom, European Union, or Switzerland, our lawful basis for processing your personal information may be consent, compliance with legal obligations, or the pursuit of our own legitimate business interests.

3. Sharing your information

(a) How we share your information

i. Our service providers:

We share your information with third-party service providers for the purpose of providing the Service to you, to facilitate 250 Mils’ legitimate interests or if you consent. These service providers are vetted by us, and will only be provided with access to your information as is reasonably necessary for the purpose that 250 Mils has engaged the service provider. We require that such third parties comply with applicable laws, and have security, privacy and data retention policies consistent with our policies to the extent necessary for them to perform a business or technology support function for us.

Some of the limited number of third-party vendors with whom 250 Mils may share your personal information are service providers who assist 250 Mils with functions such as:

  • Billing;
  • Customer support and customer management;
  • Email services;
  • Hosting and storage;
  • Data analytics and predictive analytics;
  • Data labeling and machine learning;
  • Security;
  • Advertising and marketing services;
  • Domain name registration;
  • Delivery of physical products; and
  • Other service providers.

ii. Third party cookie and analytics providers:

We may share your personal information with third parties, such as providers of cookies and other analytics tools that we use on our Website so that we can support the in-Website experience and personalization, including recommendations, perform research and analysis about your use of, or interest in, our Website, and perform marketing activities, which may include audience development and targeting. Under certain state privacy laws, this disclosure of information may be deemed to be a "sale" or a "share" of your personal information. The California Consumer Privacy Act (the "CCPA"), defines a "sale" as disclosing or making available to a third party personal information in exchange for monetary or other valuable consideration, and it defines "share" in pertinent part as disclosing personal information to a third party for cross-context behavioral advertising.   • Geolocation data As discussed below, you may opt out of the sale or sharing of your personal information for these purposes

When we transfer your data to our vendors under the Data Privacy Framework, we remain responsible for and liable under the Data Privacy Framework Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless 250 Mils proves that it is not responsible for the event giving rise to the damage.

iii) Sharing in connection with a merger, acquisition or reorganization

250 Mils may also share, sell or transfer your information to third parties in connection with or contemplation of (including as part of the due diligence process) any merger, acquisition, reorganization, financing, sale of assets, bankruptcy or insolvency event involving 250 Mils or any portion of our assets, services or businesses. Information such as customer names and email addresses, User Content and other user information related to the Service may be among the items shared, sold or otherwise transferred in these types of transactions. You will be notified via email and/or a notice on the Service if such a transaction takes place and be given notice of any material changes to the way we handle your data under this policy.

iv. Your employer or other organization associated with your email address.

If you sign up for the Service using an email address associated with your employer or another organization ("Admin Entity"), this 250 Mils account will be an "Administered Account" and 250 Mils may share your name, email address, and basic account activity information with the Admin Entity; and transfer control of the Administered Account to the Admin Entity.

If your Administered Account is transferred, the Admin Entity’s admin will be able to access, transfer and control your Administered Account and all content and designs associated with it, as well as: make changes to the Administered Account and billing settings and privacy preferences;

  • make changes to the folder permissions; and
  • delete the Administered Account.

If your Admin Entity has requested control of your Administered Account, 250 Mils will provide you with notice and the opportunity to transfer your content and designs to a personal 250 Mils account (subject to you providing us with a valid email address) before the Administered Account is transferred to your Admin Entity.

v. Sharing with other third parties

250 Mils will also share your information with third parties in certain circumstances, such as where you consent to sharing it with a third party for a particular purpose.

Third-Party Privacy Policies: Any third parties to whom we may disclose personal information may have their own privacy policies which describe how they use and disclose personal information. Those policies will govern use, handling and disclosure of your personal information once we have shared it with those third parties as described in this Policy. If you want to learn more about their privacy practices, we encourage you to visit the websites of those third parties. These entities or their servers may be located either inside or outside the United States.

vi. Sharing aggregate data

We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated such anonymized data with third parties.

vii. Sharing with authorities

We access, preserve and share your information with regulators, law enforcement, police, intelligence sharing and take down services and others in accordance with our Authority Request Policy(opens in a new tab or window) or where we have a good-faith belief that it is necessary to detect, prevent or address fraud, breaches of our Terms of Use(opens in a new tab or window) or Acceptable Use Policy(opens in a new tab or window), harmful or illegal activity, to protect 250 Mils (our rights, property or intellectual property), you or others, including as part of investigations or regulatory enquiries or to prevent death or imminent bodily harm.

250 Mils will obtain assurances from its agents that they will only process the data for the limited and specified purposes consistent with the consent provided by the individual and will safeguard personal information consistently with this Policy. The assurance may include: a contract binding the agent to provide at least the same level of protection as is required by the relevant Data Protection Framework Principles or CCPA, as applicable, being subject to GDPR, or Data Protection Framework certification by the agent.

(b) How you can share your User Content

(i) Public Posts:

When you upload Content, post a comment or message on the Website, provide information in connection with features such as date related features and notifications, fan clubs, wish lists, Chats, forums, member profiles, reviews and recommendations, or use the Social Features, your Username, and any other uploaded content such as review images, may be visible to other Users.

Additionally, if your comment, Chat, or message contains personal information and is posted by you in a page that is accessible to the public, we will collect that information and use it for the purposes described in this Notice. Additionally, third parties may make note of the information, and you may receive unsolicited messages from other parties as a result. Any Content or other information you upload that is visible to third parties may be read, collected, and used by others who access the relevant webpage(s), particularly in conjunction with the Social Features. Our blog is managed by a third party application, WordPress, and does not require you to register to post a comment to a post. if you want the personal information that was posted to the comments section removed. To learn how WordPress uses your information, please review their privacy policy. You may also contact 250 Mils to have information removed from the Social Features, if you are not able to remove the information via self-service functionality.

You may also choose to submit a product review. We may also request you complete a review of the Apps or products, via a third party, or offer an incentive if you submit a review. If you post a review, we may ask for certain information to validate your review such as email address, photo, and your city/state/country of residence. If you submit a review, we may publish your geographic location or other anonymous information but your email address will be kept private.

(ii) Teams:

If you are part of a Team, then any information or content that you create in that Team or activity you take within the Team may be shared with other Team members and the Team Owner. If requested by the Team Owner, 250 Mils may re-assign ownership of any User Content you post in the Team to the Team Owner or to another Team member. The Team Owner or any Team Administrator in your Team may also move, delete or edit any folders or items you share with them, or the Team. You should ensure that any personal information, confidential information, or User Content that you’d like to keep private is retained in a separate personal account.

(iii) Design Collaboration:

If you accept an invitation to view or edit a PosterMyWall design: your name and avatar will be visible to anyone else in the design at the same time as you, whether or not they are logged in to PosterMyWall or anonymous; your name and time of login will become available to any other person that also has edit access to that design, whether or not they are within your Team.When you purchase products from the Site, we may use your email address or other personally identifiable information to send marketing messages and notifications from time-to-time whether or not you created an account with us. You may unsubscribe or change the frequency of email notifications on the Account Settings page in "My Account." If you email a product to a friend or refer a friend to the Site or our promotions, we will use your friend's email to send them the email you requested. Your friend's email addresses will only be used for this purpose unless permission is otherwise granted. 250 Mils does not store this information. Your friend may contact us at privacy@250mils.com to request that we remove this information from our database.

4. Cross-Border Data Transfers & Data Privacy Framework

250 Mils Global Privacy Practices:

Information that we collect will be stored and processed in the United States in accordance with this Privacy Policy. However, we understand that we have users from different countries and regions with different privacy expectations, and we try to meet those needs. 250 Mils participates in the Data Privacy Framework as further detailed below, and all the types of information collected, and purposes enumerated within this notice may be covered by the Data Privacy Frameworks. You may also exercise your personal data rights as further described in this Notice.

250 Mils is subject to the investigatory and enforcement powers of the Federal Trade Commission. The Data Privacy Framework Principles are: Notice, Choice, Accountability for onward transfers, Security, Data integrity, and purpose limitation, Access, and Recourse, enforcement and liability. 250 Mils LLC ("250 Mils") complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.

250 MILS has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. 250 Mils has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.

Regarding 250 Mils’ liability in cases of onward transfers to third parties, a DPF participating organization has responsibility for the processing of personal information it receives under the DPF and subsequently transfers to a third party acting as an agent on its behalf. 250 Mils shall remain liable under the Principles if its agent processes such personal data in a manner inconsistent with the principles unless 250 Mils proves that it is not responsible for the event giving rise to the damage.

Pursuant to the Data Privacy Frameworks, EU, UK, and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. If you have an account, you can access, update, or correct your information by using our account management features. Otherwise, an individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States under the Data Privacy Frameworks, should direct their query to privacy@250mils.com. If requested to remove data, we will respond within a reasonable timeframe.

We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, 250 Mils commits to resolve DPF Principles-related complaints about our collection and use of your personal information. EU, UK, and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF should first contact 250 Mils at: privacy@250mils.com.

250 Mils has further committed to refer unresolved privacy complaints under the DPF Principles to an independent dispute resolution mechanism. JAMs, an alternative dispute resolution provider located in the United States is 250 Mils’ independent recourse mechanism.

If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://www.jamsadr.com/dpf-dispute-resolution for more information and to file a complaint at no cost to you. If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. 5. Data Retention

We will retain your personal information for the period necessary to fulfill the purposes outlined in this Notice unless a longer retention period is required or permitted by law or defined in an agreement. We may retain personal information for longer where required by our regulatory obligations or professional indemnity obligations, or where we believe it is necessary to establish, defend or protect our legal rights and interests or those of others.

We will also retain usage data for internal analysis, or to strengthen the security or improve the functionality of our Website.

6. Accessing, Changing, deleting, or updating my information:

Upon request, we will provide you with access to the personal information that we hold about you. You also may correct, amend, or delete the personal information we hold about you. Most of your account information can be changed in the "Edit Profile" section of the Site. After receiving proof of your identity, we will provide the information to you, and you may request that we correct, amend or delete any or all of the information. We will respond to your request to access within thirty (30) days of receipt. We will retain your information for as long as your account is active or as needed to provide you Websites. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.

7. Children's privacy

Our Website is not directed at children under the age of 16. If you are under the age of 16, you may not use our Website or provide your information to us through the Website or otherwise. We do not knowingly collect, sell, or share personal information from children under the age of 16. We encourage Parents and legal guardians should monitor their children’s Internet usage.

10. Additional information for Users in Certain Jurisdictions

A. California

In this section, we provide information for California residents as required under California privacy laws, including the California Consumer Privacy Act (the "CCPA"), which requires that we provide California residents certain specific information about how we handle their personal information.

Categories of personal information that we collect and disclose. Our collection, use and disclosure of personal information about a California resident will vary depending upon the circumstances and nature of our interactions or relationship with such resident. The Section above entitled "Personal Information We Collect" sets out the categories of personal information (as defined by the CCPA) about California residents that we have collected and disclosed to others for a business purpose within the past twelve months. We collect these categories of personal information from the sources described in the Section above entitled "Personal Information We Collect and How We Collect It," and for the purposes described in the Section above entitled "How We Use Personal Information."

You may have the right to limit our processing of sensitive personal information to the extent that we use sensitive personal information for any purpose other than: (1) to perform services or provide good reasonably expected by a consumer who requested those goods or services; (2) to detect security incidents provided that the use of personal information is reasonably necessary and proportionate for this purpose; (3) to restrict, malicious, deceptive, fraudulent, or illegal actions directed at us and prosecute those responsible for those actions, provided the use of personal information is reasonably necessary and proportionate for this purpose; (4) to ensure the physical safety or natural persons, provided the use of the personal information is necessary and proportionate for this purpose; (5) for short-term transient use, including but not limited to non-personalized advertising shown as part of the consumer's current interaction with us, provided the personal information is not disclosed to another third party and is not used to build a profile about the consumer or otherwise alter the consumer's experience outside the current interaction with us; (6) to perform services on behalf of us, such as maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business; or (7) to verify or maintain the quality or safety of a service or device that is owned, manufactured by, manufactured for, or controlled by us.
  • Request to Delete: California residents have a limited right to request deletion of their personal information that we have collected about them and to have such personal information deleted, except where an exemption applies. We will respond to verifiable requests received from California residents as required by law. The instructions for submitting a verifiable Request to Delete are described below.
  • Request to Know: California residents have the right to request and, subject to certain exemptions, receive a copy of the specific pieces of personal information that we have collected, used, disclosed and sold about them in the prior 12 months and to have this delivered, free of charge, either (a) by mail or (b) electronically in a portable and, to the extent technically feasible, readily useable format that allows the individual to transmit this information to another entity without hindrance. California residents also have the right to request that we provide them certain information about how we have handled their personal information in the prior 12 months, including the:
    • categories of personal information collected;
    • categories of sources of personal information;
    • business and/or commercial purposes for collecting and selling their personal information;
    • categories of third parties with whom we have shared their personal information;
    • categories of personal information that we have sold in the preceding 12 months, and for each category identified, the categories of third parties to which we sold that particular category of information; and
    • categories of personal information disclosed for a business purpose in the preceding 12 months, and for each category identified, the categories of third parties to which we disclosed that particular category of personal information.
  • Request to Correct: California residents have the right to request correction of inaccurate personal information that we maintain about them.
  • Right to non-discrimination: The CCPA prohibits discrimination against California residents for exercising their rights under the CCPA. Discrimination may exist where a business denies or provides a different level or quality of goods or services, or charges (or suggests that it will charge) different prices, rates, or penalties on residents who exercise their CCPA rights, unless doing so is reasonably related to the value provided to the business by the residents’ data. We do not differentiate or discriminate among users based on their exercise of their rights under the CCPA.

Verification process for requests: We will acknowledge receipt of your request, to know, correct, or delete verify it using processes required by law, then process and respond to your request as required by law. To verify such requests, we may ask you to provide the following information:

  • For a request to know categories of personal information which we collect, we will verify your identity to a reasonable degree of certainty by matching at least two data points provided by you against information in our systems which are considered reasonably reliable for the purposes of verifying a consumer’s identity.
  • For a request to know specific pieces of personal information or for requests to correct or delete, we will verify your identity to a high degree of certainty by matching at least three pieces of personal information provided by you to personal information maintained in our systems and also by obtaining a signed declaration under penalty of perjury that the requestor is the consumer whose personal information is the subject of the request.

Authorized agent requests: An authorized agent can make a CCPA request on a California resident’s behalf by providing either: (1) a power of attorney valid under California law; or (2) proof that the consumer gave the agent signed permission to submit the request. The consumer must also provide either: (1) verification of their own identity with respect to a right to know categories, right to know specific pieces of personal information, or requests to delete which are outlined above; or (2) direct confirmation that the consumer provided the authorized agent permission to submit the request.

You can contact us to exercise any of the rights you are granted under applicable data protection laws, which may include the right to (1) access your data, (2) rectify the data, (3) erase data, (4) restrict the processing of your data, (5) the right to receive a file of your personal information, (6) the right to object to the processing, and (7) where we have asked for your consent for processing, withdraw this consent. These rights will be limited in some situations.
